Sater jury begins deliberations

Park Rapids, Minn. -- A seven-man, five-woman Hubbard Caounty jury on Tuesday was deliberating the fate of a 17 year old Grand Rapids girl accused of being involved in the first-degree murder of a Grand Rapids Gangster disciples gang member.

Kellie Sater drove william "Will" Booth to the scene of the his murder knowing he would be harmed, and she gained rank in the gang as a result of the slaying, Itasca county prosecutor Bernard Bodien told jurors inhis closing argument.

Booth, 18, of Deer river, was shot and stabbed to death at a mine dump near Coleraine Oct. 20.

Sater's Duluth defense attorney, Richard Holmstrom, called it as case of false accusations supported by a singler pillar -- the testimony of bradley Yost. He called Yost the "real dealer of death. Knock that pillar out and the entire case falls," Holmstrom said.

Yost, the 26-year-old gang leader, admitted inflicting the fatal stab wound into the back of Booth's neck but said Sater also stabbed the victim in the neck at his request. He agreed to testify for the prosecution in the trials of the other people accused of being involved in Booth's murder and was allowed to plead guilty to intentional second-degree murder.

As part of his plea agreement, Booth escaped the possibility of being convicted of first-degree murder and its resulting mandatory life prison sentence. Two other gang members -- a 16 year old boy with mental health problems and a 19 year old woman -- also testified for the prosecution against Sater after reaching plea agreements.

Holmstrom told jurors the prosecution's witnesses were "a collection of immunized witnesses, deal seekers, narctics addicts, jailhouse informants out for a fast buck and the mentally distrubed."

Bodien said Yost may be a bad person and a killer but that doesn't mean he didn't tell the truth. The prosecutor told jurors it took courage for Yost to testify about what he did. He said Yost gave consistent statements to investigators while Sater initially lied by denying she knew anything about Booth's disappearance.

After eight days of hearing testimony, jrors began their deliberations at noon. they considered four charges against Sater: murder in the first degree as an accomplice, intentional murder in the second degree as an accomplice, second-degree felony murder as an accomplice while committing or attempting to commit assault and second-degree murder as an accomplice for the benefit of a gang.

According to the instructions of law that Judge Jon Maturi read to jurors bebore they began their deliberations: "A defendant is guilty as a accomplice if a crime is committed by another person when that defendant has intentionally aided the other person in committing it, or has intentionally advised, hired, counseled, conspired with or otherwise procured the other person to commit it."

Gang members testified that they thought Booth was to be beaten -- "stiches for snitches" one said -- because they thought he was a police informant.

Sater admits driving Booth, Yost, and fellow gang members Stephen Schouenborg and Amy Cooper to a mine dump near Coleraine after dark last October. she testified Monday that she thought the gang members were going to talk to Booth about what he wanted done to some people who had thrown human feces, Ninja stars and darts at him. She said she'd didn't know he was going to be harmed.

However, other gang members testified that they saw Sater slap booth and threaten to "get him." One testified that Cooper feared she would lose her baby because she thought Booth was talking to police about her gang involvement. cooper allegedly said she wanted Booth "taken out."

Sater testified that Schouenborg shot Booth and Yost stabbed him as she and Cooper looked on. She said that she and Cooper then prayed over the body as Yost requested. Schouenborg and Cooper have been indicted on first-degree murder charges and have upcoming trials.

Another gang member testified that Sater became a member of the gang and one of its highest-ranking officers after Booth was killed. Sater denied that she ever became a gang member.

Bodien told jurors Sater was responsible for booth's death in the same way that a "wheelman in a bank robbery is just as responsible as the person who went into the bank."

Holmstrom left the podium, walked directly infront of the jurors and asked them to give Sater back to her family.

"The state is trying to snatch away the liberty of a young, impressionable 17 year old child on the word of a 26 year old witchcraft practitioner, admitted murderer and gang leader who is getting a reduced sentence to implicate others." he said.

Jourors deliberated for seven hours Tuesday without reaching a verdict. before being excused for the day, they asked the court for the testimony of three witnesses. Two of those were in jail with Sater and the third has a forgery conviction. all three women testified that Sater knew Booth was in trouble with the gang.

Maturi told jurors to try to work their way through any questions they may have. He denied their request but said he may later reconsider.

The jury was sequestered in a local motel around 8:45 pm Tuesday. They are expected to resume deliberations at 8:30 am today
